An estimated 52% of Bolivia’s population have no access to sanitation and 80% of wastewater is not treated before re-entering the environment. The Water and Sanitation for All project aimed to guarantee the right to sanitation in the San Pedro Magisterio neighbourhood by successfully building and running a wastewater treatment plant and strengthening community management of the entire water cycle through the neighbourhood’s Cooperativa de Agua San Pedro Magisterio.

Pollution in Cochabamba’s river reached such high levels in 2012 that the government declared it an “environmental disaster”. The Water and Sanitation for All project was born from a demand and a request from a community: the San Pedro Magisterio cooperative felt the need to treat domestic wastewater in its area to avoid polluting the Rocha River and the environment.

Assemblies with all cooperative members were held to discuss the technical design of the water treatment plant, improvements to domestic use of the sewerage system, and the introduction of a new tariff structure guaranteeing the system’s economic sustainability – all of which encouraged the community to take ownership of the initiative. The cooperative committed to taking on the running of the treatment plant once built, and environmental awareness activities were held in the local school.

But it was not all plain sailing. The municipality, through its water operator, attempted to sabotage the project, criticizing the technical design of the plant and refusing to issue the environmental permits required to execute the project. It also tried to divide the community.

But the community’s unity and determination overcame this, challenging the state-municipal authorities by defending their right to manage water as a community, establishing alliances (with other neighbourhoods and public servants) to resist political pressure, and strengthening their participatory and transparent internal decision-making mechanisms. The project is now responsible for treating the wastewater from 300 families, and for improvements to the hygiene and sanitary conditions in the San Pedro neighbourhood.

Since 2001 the Mexican government has been pushing municipal governments to privatize water. If this trend continues, 35 million people will be affected and community water management – with water systems built by the people and dating back more than a hundred years in some cases – will be destroyed. SAPTEMAC is challenging this through its Water School, giving local people the tools to defend their water supply.

Mexico’s Water School came about in 2016 when SAPTEMAC representatives saw the concept at work in Colombia. With the support of national umbrella group Water For All, Water For Life – and with no major funding – professionals including lawyers, engineers, accountants, geographers and teachers have been running training sessions in different locations to give people the professional and political means to defend themselves. Topics covered include water rates, account-keeping, billing, organisation and inventories, pipes and water pumps.

So far there are 25 systems involved in the project, and water users, students and academics who have participated in the project have volunteered to strengthen the school by contributing new theoretical and political tools for use in the second round of training sessions in 2018.

Water For All, Water For Life already runs a citizens’ initiative for a General Water Law, but SAPTEMAC is now complementing this with a campaign for local water laws with the same human rights approach in 16 states around the country. The most significant result achieved to date is that colleagues from other community water systems have expressed interest in participating in the Water School project in its second round of training.

Eau de Paris (EDP) was set up to end a fragmented, opaque and expensive municipal water service. Relying on strong political will, the city of Paris has worked to make water management a major democratic issue, ensuring better-managed and cheaper water supplies, and an environmental strategy that is second to none.

Before 2010, Paris’s water service was provided by four entities:  two private companies, Suez and Veolia; SAGEP, a public/private company using public drinking water infrastructure, and a public laboratory in charge of water safety. This situation diluted responsibility and hiked the price of water for users. That is why the Paris municipality decided to fully remunicipalise and reintegrate water services, at the end of the current contracts EDP captures, produces and distributes 170 million cubic meters of drinking water a year for 3 million users.

EDP began operating Paris’s water systems in January 2010 with a fully integrated water management, from source to tap. From the first year, the structural savings of about 30 million euros per year made it possible to lower the price of water by 8%. Today, this price is still lower than it was before 2010. EDP also ensure a concrete right to water through free public fountains in public spaces, cooperation with associations supporting homeless people and refugees, and partnerships with social landlords.

EDP has adopted environmental management practices in all the natural spaces it manages and supports many farmers in setting up sustainable farming practices, that are useful for water quality.

Johannes Euler: In Cochabamba, Bolivia, the lack of water has caused conflicts for decades. In 1999, Cochabamba’s public water supplier, SEMAPA, was leased to the international consortium Aguas del Tunari. The major shareholder of the consortium was the multinational company Bechtel. In the course of the privatization procedures, independent water and irrigation systems and autonomous water services were threatened with expropriation. Water prices rose steeply as a result. In response, several civil society groups formed the “Coordinadora de Defensa del Agua y de la Vida” (Coalition for the Defense of Water and Life). Protests against these policies were fierce, lasted several months, and raised the issue to national and international levels.

Eventually, Aguas del Tunari was expelled. Control of SEMAPA was transferred to representatives from the municipality, the trade union, and the Coordinadora (though these arrangements have subsequently changed). The statutes of the hybrid company were rewritten in a challenging participatory process, but SEMAPA is still known for its lack of efficiency and transparency. Moverover, the state is currently trying to extend its sphere of control into the water sector. However, the so-called Cochabamba Water War contributed to major changes in Bolivia’s water sector, the respective laws, the establishment of a national Ministry of the Environment and Water, and of the country as a whole.

Key points of Bolivian policy reforms sparked by the Cochabamba Water War:

  • In 2000, the pro-privatization Law 2029 was canceled and rewritten as Drinking Water and Sanitation Services Law (2066). It was the result of negotiations between social movements and the state during the water wars. It recognized marginalized communities’ rights to use water and differentiated them from capitalist activities, which had to be authorized and were subject to fees.
  • In 2004, similar principles were applied to the irrigation sector (Law 2878), which recognized decentralized irrigation governance. Both laws support indigenous people and farm laborers from being dispossessed of water. At the same time, they contributed to the formalization of water management, which tends to favor commercial management over community management.
  • The Bolivian constitution was changed in 2009. Prior to 2009, water supply concessions could be granted for up to 40 years. The new constitution considers water a basic right of life and bans the typical methods of privatization and leasing of water services to for-profit entities.

Sustainability and public participation are declared to be the responsibility of the state as well as universal access to water. To which extent these intentions will actually be reflected in reality remains to be seen, however. The responsibilities coming with this basic-rights approach demand action by the state and challenge community management at the same time.

In 1983, a right-wing mayor was elected in Grenoble. His administration was marked by corruption and the power he gave to large corporations in the management of public services. Elected officials and environmental activists mobilised in the 1980s and 1990s to prove that corruption was involved in many deals, and set up an alternative, municipal entity to take back and run the water utility.

The decision to remunicipalise the water system due to corruption, lack of transparency and abusive tariffs was taken in March 2000 and implemented in 2001, with the immediate cancellation of the contract with private company Suez.

Under municipal water company Régie des Eaux de Grenoble (REG) investment in infrastructure increased threefold, while maintaining the price of water at lower and steadier levels. The new public enterprise adopted an advanced form of public participation in decision-making by establishing a water users’ committee. One third of the members of the REG’s board of directors are now civil society representatives and the other two thirds are municipal councillors.

A few years after Grenoble’s experience, the City of Paris decided to remunicipalise its water service. Between 2000 and 2008, this allowed users to save €20 million, mainly through improved maintenance resulting in more efficient water use. The city then launched a social water tariff policy: households for whom the cost of the service exceeds 2.5% of their annual income are reimbursed part of the amount by the CAF. In parallel to the social strategy, the goal is to maintain a pure and untreated water supply – the only case in France.

In 1999 a small group of Berliners found out that almost 50% of shares in the Berlin Water Works had been covertly sold to Veolia and RWE as part of a public-private partnership deal. After demanding a referendum so that citizens could vote to see the secret contract, the Berlin city government felt under so much pressure it bought back the shares and remunicipalized the city’s water provision.

The initiative started when a small group of members of Attac Berlin discovered that the Berlin Government had sold 24.9% of the shares to RWE and Veolia (each). The group organised a big event in a circus in Berlin to inform people, at the end of which an invitation was extended to those interested in founding an assembly of Berliner Wassertisch (Berlin Water Table). While many attendees were members of trade unions, political parties and other groups, as part of the assembly each person represented only themselves (a principle that remains to this day).

The five-year struggle (2006-2011) for the referendum was necessary because without it, the contract would have remained secret, denying campaigners the grounds to go to court. While no political party or media supported the fight, Berlin citizens were so outraged about the secrecy of the contract they voted in favour of the referendum.

To get the referendum granted in the first place, 25,000 signatures were needed, but the group got more than 36,000. Then the Berlin Government forbade the group to publish the secret contract on grounds that it would be against the German constitution, forcing them to go to the Berlin Constitutional Court, which ruled in their favour. And when the referendum was held, 98% of the more than 660,000 turnout voted for publishing the contract.

The pressure was so great that the Berlin Government bought back RWE’s shares in 2012 and those of Veolia in 2013. Thanks to the referendum, Berlin Water was remunicipalized in 2014.

After 20 years of privatized water supplies in Valladolid, Spain, residents led the way to remunicipalizing this key service by successfully taking on the existing private contract holder, and central government too. As a result, a 100% public entity has now very successfully taken on running the utility.

For decades, citizens in the Spanish city of Valladolid had endured poorly run and expensive water provision. But in 2015, municipal elections ushered in a new three-party coalition government – and though each of the three had differing platforms, all included the remunicipalization of public water management in their electoral programme. As the contract (held by private company Aguas de Valladolid) was about to expire, water management emerged as a key political topic for the first time in 20 years.

Valladolid Toma La Palabra (VTLP), the municipalist movement running the environment department of the new City Council, held lectures and open debates, and, once the decision to remunicipalize through a public enterprise was reached, the 100% Public Water Management Platform (PWMP) was set up. Its member organizations were ecologists, neighbourhood associations and others.

Despite lobbying by the private sector, and laws restricting local government from ‘indebting’ itself by investing in water infrastructure, a new public company was set up and is now successfully managing the water supply in Valladolid. The management has been democratized through the composition of the board, new investment will start soon, and charges to customers remain frozen. The new public company will apply low tariffs according to income levels, resulting in a higher number of beneficiaries.

Other big Spanish cities such as A Coruña, Santiago de Compostela, Vitoria, Sevilla, Zaragoza, Madrid and Barcelona have requested information about the Valladolid case in order to start their own processes.

The oceans were the original global commons, shed and navigated for ages. But new technologies have added numerous challenges to sustaining our oceans: offshore oil drilling, deep-sea mining, and overfishing. However, it’s crucial that water, both freshwater and saltwater, remains a commons and held in the public trust, because access to clean and affordable water is a basic human right.

A widespread approach to delivering water to cities consists of establishing a municipal entity, under direct or indirect local governmental control, that collects water dues from all customers (residential as well as businesses). Water rates are determined through a political process, and are intended to provide affordable water supply and sewage treatment while covering the costs. Public water supplies of this kind are often highly successful, especially in countries where there are effective methods to keep local government accountable to its citizens. However, in some cases, municipal water utilities may become inefficient (providing a service of low quality or at high cost) if insufficient incentives are built into the system to ensure that the service is continually upgraded. In extreme cases, municipal utilities may fall seriously behind in provisioning growing cities, or may provide jobs as a form of political patronage.

One type of water distribution, beyond public and private, is a cooperative system, where the distribution system is owned by its customers. The existence of this alternative is too often ignored, but it is by no means rare. For example, in the U.S., there are over 3,000 rural water cooperatives, which were set up since the New Deal in order to cheaply build up and maintain a water supply infrastructure in the rural areas of the country.

Regardless of the ownership of a water utility (public, private, or cooperative), a utility may return polluted water to a river or the sea — especially if downriver users are not able to make an impact on decision-making. 1. Tarun Bharat Sangh: Fostering Community-driven Solutions to Secure Water Access and Rejuvenate Rivers

India makes up around 18 percent of the global population, and yet only has access to 4 percent of the world’s drinkable water resources, according to CNN. Since the 1980s, both rural and urban areas in the country have faced drinking-water shortages and crop failures. This scarcity is exacerbated by river pollution associated with sewage disposal and industrial waste. To address this crisis, in 1985, Rajendra Singh and others formed the local nongovernmental organization Tarun Bharat Sangh (TBS, or Young India Organization) in Alvar, a rural district in Rajasthan.

TBS has worked with rural villagers to revive the use of traditional water-harvesting solutions. In particular, they used “johads” (small earthen reservoirs) to harvest rainwater in a way that reduced evaporation losses to substantially replenish local aquifers. People also shifted to organic farming techniques to make more efficient use of water. TBS advocated for these and other methods of water management as a way to bring about a culture of self-sufficiency to local farming communities. The River Arvari Parliament expanded on this objective. Following the revival of the Arvari River in 1990, representatives from the area’s 72 villages formed the transparent, community-driven “river parliament” to maintain the health of the river. To date, Rajasthan communities have created and managed more than 11,000 johads, replenishing more than 250,000 wells. Within 28 years, seven river systems that had been dried up for 80 years have been revived. —Nikolas Kichler

2. Resident Development Committees: Community-led Management Over Local Water Supplies

Among the African nations, Zambia is one of the most rapidly urbanizing countries in the continent. In its capital, Lusaka, 60 percent of the population live in unplanned settlements that are an urban and rural hybrid. This has led to extensive administrative challenges over clean water and public sanitation. In response, the Lusaka Water and Sewage Company, the Lusaka City Council, and various nongovernmental organizations worked together to develop Resident Development Committees (RDCs). The RDCs provide legal entities for local residents to foster cooperation with unplanned neighborhoods, thereby allowing planning, construction, and maintenance of water utilities to become self-organized and co-managed through them. Financial responsibilities, such as fee collection, are also under their jurisdiction. Over time, the RDCs have become the primary managing units for local collective decision-making over water issues, and have sustained a regular flow of information, transparency, and accountability to the communities they represent. Many neighborhoods now have access to a reliable and largely self-sustaining source of clean water. The benefits of RDCs for unplanned communities have been so convincing that formally planned areas are also advocating for the same model. 3. depave: Communities Turning Pavement Into Green Public Space

Paved surfaces contribute to stormwater pollution, by directing rainwater with toxic urban pollutants to local streams and rivers. This, in turn, degrades water quality and natural habitats. Since Portland receives a lot of rain, impervious pavements are especially problematic for the city’s stormwater management. Two friends from Portland thought of a straightforward solution to this problem: remove as much impervious pavement as possible. They organized their first official depaving event in 2008. Since then, they formed depave, a nonprofit organization that promotes the removal of pavement from urban areas to address the harmful effects of stormwater runoff, as well as to create green public spaces. depave seeks out groups that are already community-oriented, such as schools and faith-based groups, and encourages them to work together on the same project. depave has coordinated over 50 depaving projects in Portland. Eric Rosewall, depave’s co-founder, reports the organization has depaved more than 12,500 square meters of asphalt since 2008, diverting an estimated 12,000 cubic meters of stormwater from storm drains. The Amrta initiative works to end water privatization in Jakarta and enable a transition to good, publicly run water services. Through research, public discussions and collaboration with civil society, this initiative has pushed the city government to announce plans to remunicipalize Jakarta’s water supply.

Jakarta’s governors have traditionally been (quietly) supportive of ending water privatization in the city, and in 2013, the governor of Jakarta heeded residents’ calls and declared a plan to take over water services from the private sector. Public water company PAM Jaya demanded a contract renegotiation with the private water operators, and the provincial government of Jakarta announced a plan to purchase private water operators’ shares. In 2013, the provincial house of representatives approved a budget for PAM Jaya to proceed with share repurchase.

One particularly effective strategy in November 2012 involved residents, represented by legal aid organisation LBH Jakarta, filing a citizen lawsuit against water privatization in Jakarta. Amrta Institute supported the challenge with evidence for use in court. This long and successful legal challenge played a major role in maintaining political pressure.

The backdrop to this – two decades of failed water privatization in Jakarta and half the population having no piped water – led the Amrta Instite to run public media campaigns, produce popular publications about the issue, and make documentaries.

At first most people were not aware that water problems were the result of privatization, and that the solution was to return water services to public management. But now we have decisions from three courts supporting public water management; the Constitutional Court decision, Central Jakarta District Court decision and Supreme Court decision. In October 2017, the governor told the media that he will implement the court decision.

A woman who was washing in Penjaringan, North Jakarta, admitted that the cost to buy water consumed almost 70% of her husband’s income.

Pani Haq Samti’s ‘People’s Campaign’ had the dual aim of mobilizing public opinion to oppose the privatisation of water supplies in the Indian state of Maharashtra, and securing the distribution and re-establishment of water as a right.

In Mumbai, the right to water in people’s settlements (known as slums) was revoked in 1996 when the Maharashtra Urban Development Department instructed all municipal corporations to stop water infrastructure being installed in them.

Since then, the right to water and sanitation has been deeply neglected in these communities. An estimated three million people in Mumbai have no access to water and lack of sanitation forces 70% of them to defecate in the open. Those living in people’s settlements buy expensive, low-quality water from private suppliers – a time-consuming activity, especially for women, young girls and children.

Against this backdrop, Pani Haq Samiti (PHS, Committee on the Right to Water) came about. Its members included people’s settlement residents, activists, academics and non-governmental organisations. It relied on voluntary donations while other institutions and organisations helped with technical expertise, research support, advocacy strategies, strategy and legal support, all of which helped mobilize people.

As the mobilisation took off, people demanded greater transparency, and this coalesced into the Pani Haq Abhiyaan (Right to Water movement), creating widespread awareness of water privatization by raising it with political parties, elected officials, members of the Legislative Assembly and Parliament.

Eventually, widespread agitation and fierce campaigning across the city resulted in denial of water to people’s settlements being shelved, and two state judges stating that whether homes are deemed ‘legal’ or ‘illegal’, Article 21 of the Indian Constitution – the right to life – intrinsically implies it is the responsibility of the government to provide water to all. On 9 January 2017 a circular was issued to all municipal officials to implement the policy.

The judgment and subsequent policy change have been the campaign’s biggest achievements. People have been the biggest beneficiaries of this as water connections will be available to them, irrespective of the ‘legality’ of the settlement. Moreover, water provided will be through the Municipal Corporation, and not expensive private sources.
